Highly regarded law commentator and Preiskel & Co Consultant, David Allen Green, gave the first of a planned series of Brexit seminars to leading individuals from the legal, business, political and media worlds on Friday 25 October 2019.
At the seminar, entitled “Brexit: Where are we now?”, David explained the key reasons why Brexit has not yet been achieved, and described the legal and procedural parameters of the UK’s political attempts to depart from the EU that have led to the delays.
In particular, David set out the structural issues that shape the politics of Brexit (and which in turn can be shaped by politics): the nature of the UK constitution, the Good Friday Agreement, the devolved administrations, the constitutional and legal relationships of UK with EU, the checking roles of parliament and the courts, and the Article 50 and withdrawal agreement negotiation processes.
In addition to these structural issues, David highlighted two fundamental problems of Brexit – that the UK constitution cannot deal easily with an extra-parliamentary referendum mandate, and that Brexit is a complex and slow process that has wrongly been treated as if it could be quick and easy.
In the event of an extension, these structural issues and fundamental problems will remain.
