Preiskel & Co’s Dispute Resolution team has successfully represented a client in resisting a jurisdiction challenge in a London Metal Exchange arbitration. The dispute related to the sale of zinc ingots from a Belgium company to a Saudi Arabian counter-party.
The parties attended a remote hearing in April 2020 (during the COVID-19 ‘lockdown’ in the UK), and also submitted extensive written arguments. In finding it had jurisdiction, the Tribunal preferred Preiskel & Co’s submissions, rejected two expert reports submitted by the Respondent, and indicated that the Respondent could expect to be liable in costs.
