Ofcom opens New Programme into Mobile Providers’ Compliance

Ofcom has recently started an own initiative monitoring and enforcement programme into compliance with the charge control requirements (i.e. mobile termination rate caps) imposed by the significant market power (“SMP”) condition M3.

This condition is contained in Annex 3 of Ofcom’s Statement entitled “Mobile Call Termination Market Review 2015-18”, published on 17 March 2015.

SMP Condition M3:

  • Designates 72 mobile communication providers (“MCPs”)  MCPs as having SMP in relation to the termination of calls to UK mobile number ranges allocated to them by Ofcom; and
  • Imposes caps on the mobile termination rates (“MTRs”) which can be charged by the 72 designated MCPs.

Resellers should make sure that the caps on the MTRs are adequately applied to them.

The 72 MCPs designated by Ofcom, should make sure that they are fully complying with Ofcom’s charge controls and caps on the MTRs, as Ofcom will be now actively monitoring compliance by the designated MCPs to determine whether enforcement action is required.
