Preiskel & Co’s Dispute Resolution team, led by Robert Dougans, has successfully resisted the Kazakhstan Kagazy Claimants’ attempts to summarily obtain final charging orders against two London properties worth c. £38 million. In a 43-page judgment Mr. Justice Henshaw held that a court order had not been breached, and if it had he would have granted relief from sanctions and allowed the litigation to continue.
The judgment has been published on Bailii with citation number [2020] EWHC 2431 (Comm), available here.
The Respondents to the Applications for Charging Orders were represented by Robert Dougans and team, along with counsel William McCormick QC of Selborne Chambers, Joe-han Ho, and Rebecca Drake, both of 39 Essex Chambers.
The Preiskel & Co team included Robert Dougans, Associate, Claire Barraclough and Senior Legal Assistant, Galyna Carey.
