The new Electronic Communications Code is due to come into force in late Autumn 2017.
The New Code, when in force, will bring important changes relating to rent and private landlord’s rights. In theory, life for electronic communications providers who construct networks should be better and more certain than under the Old Code. This is a welcome development in the push for investment in future-proof telecommunications infrastructure in the UK.
The New Code will only apply to those granted Code power by Ofcom and, normally, to contracts concluded after its introduction. Electronic communications providers would be therefore be wise to review existing agreements in light of the forthcoming changes, or consider applying for Code powers.
The text of the New Code is already available in the Digital Economy Act 2017 and Ofcom have recently concluded a consultation on its newly introduced administrative requirements.
