TuneIn is a radio service which provides links to radio stations all over the world.
In 2017, the service was sued in the English High Court by Sony Music UK and Warner Music UK, on the basis that linking to radio stations in other jurisdictions, which were not licensed to play music in the region, amounted to infringement of copyright.
The case represented a very interesting opportunity for the High Court to consider what amounts to a “communication to the public” in light of recent precedent in the European Court of Justice. The judgment, handed down in November 2019, can be read here.
Following on from the judgment, TuneIn has recently prevented UK users from listening to international stations, where they do not have the relevant licenses to broadcast in the UK.
Please contact Daniel Preiskel or Martina Raciti if you have any questions relating to the judgment or copyright in general.
